Bd. Min. 2-18-72, p. 36,240; Bd. Min. 2-7-86.</p> <ol class="upperalpha"> <li><strong>These regulations are based upon the findings of this Board that reputable medical opinion has established the necessity to: </strong><br> <ol class="numeric"> <li>Protect students and members of the University community by ensuring, so far as possible, that communicable and contagious diseases will not be spread among them.</li> <li>Determine the physical condition of the individual student to assist in ascertaining whether or not he or she should participate in the physical education program, extracurricular activities, and intercollegiate athletics.</li> </ol> </li> <li><strong>It is hereby resolved by this Board:</strong><br> <ol class="numeric"> <li>That all students enrolling in the University for the first time may be required to submit satisfactory medical information.<br> <ol class="loweralpha"> <li>Any student may be suspended if he does not comply with requirements concerning the medical information or special examination deemed necessary for the health and safety of the campus community.</li> </ol> </li> <li>That there shall be a Student Health Officer on each campus appointed by the Chancellor, who shall be authorized:<br> <ol class="loweralpha"> <li>To recommend to allow any student to withdraw from the University at any time if he has a medical condition that significantly interferes with his attendance or progress at school,</li> <li>Or to require a student to withdraw from the University at any time if he has a medical condition that constitutes a hazard to himself, to other students or the campus community.</li> </ol> </li> <li>That the campus Student Health Officer be authorized to require any former student or prospective student to receive a medical clearance before being admitted or re-admitted to the University where this is deemed advisable in the best interests of the student or the campus community.</li> <li>That the campus Student Health Officer be authorized to submit to appropriate campus administrators, from time to time, in light of reputable medical opinion, such recommendations as he may deem necessary to improve health conditions for students or other members of the University community.</li> <li>The Chancellor on each campus shall, at an appropriate time, establish a policy to implement the combating and control of specific communicable diseases, including requiring immunizations and quarantines.</li> </ol> </li> </ol> </div> Thu, 27 May 2010 17:52:50 +0000 kuscheld 7530 at 280.025 Immunization Requirements /ums/rules/collected_rules/programs/ch280/280.025_immunization_requirements <span>280.025 Immunization Requirements</span> <span><span>kuscheld</span></span> <span><time datetime="2010-05-27T17:53:16+00:00" title="Thursday, May 27, 2010 - 17:53">Thu, 05/27/2010 - 17:53</time> </span> <div><p>Executive Order No. 24, 6-17-92.</p> <p>Responsibility for the development of appropriate immunization policies shall be delegated to the Chancellors of the University of èßäapp campuses. Min. 6-24-88.</p> <ol class="upperalpha"> <li>Current knowledge indicates college and university students or employees with AIDS, ARC or a positive HIV antibody blood test do not pose a health risk to either students or employees in a usual academic or residential setting. The policy of the University of èßäapp is to permit students and employees with AIDS to continue to engage in as many of their normal pursuits as their condition allows. Managers should be sensitive to the medical problem and ensure that such employees are treated consistently with the treatment of other employees. Students will be allowed to continue their enrollment and activities (including continued residency in student housing) as long as they continue to meet academic standards and medical evidence indicates their conditions are not a threat to themselves or others. Every effort will be made to maintain confidentiality at all times.</li> <li>The University also has a legitimate interest in the welfare of all students, employees, and visitors to the campus. Every reasonable precaution will be taken to minimize the risk that an employee's or student's condition will present a health and/or safety hazard to others.</li> <li>The University will not discriminate against individuals with HIV infection, AIDS or ARC, but this protection does not include individuals with secondary infections or diseases that would constitute a direct threat to the health or safety of others or who may because of the disease or infection be unable to perform duties of their employment. In such cases, the appropriate University personnel or student policy will determine what changes, if any, will be made in the student's or employee's academic or work program.</li> <li>In the event of public inquiry concerning AIDS on campus, the Chancellor or the Chancellor's designee will provide appropriate information on behalf of the University. Existing policies regarding confidentiality of employee and student records will be followed.</li> <li>Consistent with its concern for students and employees with AIDS, the University offers a range of resources through the AIDS Task Force on each campus and through other campus and èßäappservices.<br> <ol class="numeric"> <li>Student, employee, and management education and information;</li> <li>Referral to agencies and organizations that offer supportive services for life-threatening illnesses;</li> <li>Consultation to assist employees in effectively managing health, leave and other benefits.</li> </ol> </li> <li>The AIDS Task Force on each campus will continue to meet periodically to review and update policy and to make recommendations as new medical facts become available. Min. 4-12-18.</p> <ol class="upperalpha"> <li><strong>Procedure Development. </strong>Each Chancellor shall establish appropriate procedures consistent with this section for student involuntary health leave of absences. These procedures are subject to review and approval by the President and review and approval as to legal form by the Office of the General Counsel.</li> <li><strong>Scope. </strong>The adoption and the administration of student involuntary health leave of absence procedures is delegated to the Chancellor of each campus. The following general principles shall guide the adoption and administration of those procedures.<br> <ol class="numeric"> <li>That administration of student involuntary health leave of absence procedures shall be applicable to all students and be designed to protect the health, safety, and welfare of the campus community and that of the individual student to which it applies.</li> <li>That campus rules governing a student involuntary health leave of absence shall be compatible with the general rules of student conduct and equal employment/educational opportunity policies of the University of èßäapp.</li> <li>That all practices must conform to applicable state and federal laws, and University rules and regulations.</li> <li>That the procedures shall provide for an appeal of the decision for a student involuntary health leave to the Chancellor.</li> <li>That student involuntary health leave shall be imposed only if a student declines to take voluntary leave.</li> <li>That campus rules governing student involuntary health leave of absence must be placed in writing and disseminated or otherwise made available to all students to whom they apply.</li> </ol> </li> <li><strong>Procedural Components. </strong>Student involuntary health leave of absence procedures regarding students on each campus shall include clear standards for imposing a student involuntary health leave of absence, conducting individualized assessments, and assessment of risk and threat, including and addressing the following:<br> <ol class="numeric"> <li>Engaging in behavior that poses a direct threat to his/her health, safety, and welfare or that of others.</li> <li>Significant disruption of the student’s community or hampering the ability of others to participate in the educational and employment programs offered by the University.</li> </ol> </li> <li value="4"><strong>Individual Assessment.</strong> Procedures for determining the need for a student involuntary health &nbsp;leave of absence shall include the following:<br> <ol class="numeric"> <li>Examines multiple risk factors and utilizes a consistent process in evaluating the level of risk.</li> <li>Incorporates the best objective evidence with health and medical advice.</li> <li>Utilizes a multidimensional team-based approach and sharing of information, expertise, and recommendations.</li> <li>Assesses the totality of the circumstance and associated risk</li> <li>A focus on consideration for the health, safety and welfare of the campus community.</li> </ol> </li> <li value="5"><strong>Reentry Procedures.</strong> &nbsp;&nbsp;Any application of the student involuntary health leave of absence shall incorporate re-entry procedures that are reasonable, individualized, consistently applied, and seek only necessary information to determine if a student can successfully continue. Re-entry decisions must be made using a multidimensional team-based approach and allow for flexibility, as specific requirements will vary based on facts and circumstances of each individual student situation.</li> <li value="6"><strong>Conduct Violations</strong>.&nbsp; The provisions of this section notwithstanding, behavior that is alleged to violate the standards of student conduct outlined in Section 200.010 of the Collected Rules and Regulations shall be addressed under the rules of procedures provided in Section 200.020. &nbsp;Should a student who has pending disciplinary action be placed on an involuntary health leave of absence, the student conduct process will proceed upon the student’s return.</li> </ol> </div> Tue, 01 May 2018 15:40:00 +0000 kuscheld 7618 at
