Min. 9-14-00; 10-23-09.</p> <p>This policy applies to all users including faculty, staff, students, and guest users of University of èapp computer networks, equipment, or connecting resources.</p> <ol class="upperalpha"> <li><strong>University Inspection of Personal Electronic Information</strong> -- All information technology resources, including computer networks, equipment and connected resources, provided by the University of èapp are the property of the University.&nbsp; The University values the principles of academic freedom and privacy and does not condone casual inspection of the information contained within or transmitted via these resources.&nbsp; However, electronic information on University networks or equipment, including, but not limited to, electronic mail and personal information, is subject to examination by the University where:<br> <ol class="numeric"> <li>It is necessary to maintain or improve the functioning of University computing resources;</li> <li>There is a suspicion of misconduct under University policies, or suspicion of violation of Federal or State laws;</li> <li>It is necessary to comply with or verify compliance with Federal or State law including e-discovery procedures; or</li> <li>If it will serve a legitimate business need of the University.</li> </ol> </li> <li><strong>Acceptable Use Guidelines </strong><br> <ol class="numeric"> <li>Responsibilities of Users of University Computer Resources:<br> <ol class="loweralpha"> <li>Respect the intellectual property rights of authors, contributors, and publishers in all media.</li> <li>Protect user ID, password, and system from unauthorized use.</li> <li>Adhere to the terms of software licenses and other contracts. Persons loading software on any University computer must adhere to all licensing requirements for the software. Except where allowed by University site licenses, copying software licensed for University use for personal use is a violation of this policy.</li> <li>Adhere to other University and campus policies, including the Collected Rules and Regulations of the University of èapp, and, if applicable, the University Business Policy Manual, Human Resources Manual and policies established for a specific resource.</li> <li>Adhere to data access policies of the University or those established by law.</li> <li>Use University computer resources in a manner that is compliant with University policies and State and Federal law.</li> </ol> </li> <li>Prohibited Uses of University Computer Resources:<br> <ol class="loweralpha"> <li>Unauthorized or excessive personal use. Sites assigned to the University shall be subject to such regulations except that assignments or waivers provided for in such regulations shall be made by the President.</li> <li><strong>General Regulations </strong><br> <ol class="numeric"> <li><b>Intended Purpose&nbsp;</b>--&nbsp;University buildings and grounds are intended for use by students, faculty and staff in support of the University's mission of research, instruction and extension.&nbsp;</li> <li><strong>Direction of the Chancellor</strong> -- The Chancellors of the èappSystem are delegated authority for the management of the buildings and grounds of each campus. Where regulations require direction of the Chancellor, said regulations may be administered by Chancellor’s designee(s).</li> <li><strong>Religious Services or Groups</strong> -- No advantage shall be given to any religion or religious group.</li> <li><strong>Requirements</strong> -- All classes, meetings or assemblages and use by individuals of any sort held in University buildings or on University grounds are subject to applicable U.S. and èapp laws and University requirements, rules and regulations. In addition, it is expected that proper care will be taken of the facility and that simple rules of courtesy, decency and good manners will be observed at all times. Any failure to abide by these requirements may cause the permission for the use of the facility to be withdrawn at any time, or for future permission for use of any University facilities to be denied.<br> <ol class="loweralpha"> <li>The open possession of and discharge of firearms, weapons and explosives on University property including University farms is prohibited except in regularly approved programs or by University agents or employees in the line of duty. This rule shall not be construed as consent to the possession of concealed firearms, weapons, or explosives on University property.</li> <li>The possession, use, or distribution of controlled substances under state or federal law is prohibited on University property and at University-sponsored or University-supervised activities. &nbsp;The possession, use, or distribution of alcoholic beverages is prohibited on University property and at University-sponsored or University-supervised activities except as approved in accordance with Section 110.050 of these Collected Rules and Regulations.</li> <li>No University building, or part thereof, or grounds may be occupied as living rooms or bedroom except those duly set aside for such purposes.</li> <li>The University reserves the right to set reasonable time, place and manner restrictions on all meetings, gatherings or get-togethers to assure that the most beneficial use of the buildings and grounds of the University is made and that there is no interference with the right of students to obtain an education.</li> <li>The use of University facilities should not imply an endorsement of any individual, group or organization and the name of the University shall not be identified in any way with the aims, policies, programs, products, or opinions of any individual, groups or organizations which may meet in University buildings or on University grounds in accordance with these regulations.</li> </ol> </li> <li><strong>Violations</strong> -- Violations of the law or University policies and regulations may result in removal from campus. Students, faculty and staff may be subject to discipline in accordance with University policy. Non-affiliated individuals may be issued a no-trespass notice restricting access to University property when their actions are determined to constitute a threat to persons or property or a substantial disruption to the functioning of the institution.&nbsp;</li> </ol> </li> <li><strong>Use for Classrooms, Laboratories and Office Space </strong><br> <ol class="numeric"> <li>Assignment of space in University buildings for continuing use by division, departments or other units for use as research laboratories, offices or other specific purposes will be made by the Chancellor.</li> <li>Assignment of classrooms and laboratories for scheduled classes and examinations will be made on a semester-by-semester basis by the Chancellor.</li> <li>Members of the University faculty, staff or students who are assigned office space in a building on the campus, and who have been authorized to have a building exterior key, shall be authorized to use such assigned office space whenever their work may require such use.</li> </ol> </li> <li><strong>Use by Recognized Student Groups </strong><br> <ol class="numeric"> <li>In addition to the general rules and procedures, the following rules apply to use of University facilities by student groups and individuals.</li> <li>University buildings and grounds may be utilized and open to the public for appropriate activities and programs sponsored by an officially recognized student organization, provided that such programs are in accordance with the rules and regulations established by the Board of Curators for such events, and further, that the organization file a written request for approval of the activity or program at least ten days prior to the event. The Chancellor is authorized to make an exception to the ten day rule in special circumstances.</li> <li>University buildings or grounds may not be used by student organizations or enterprises which declare a dividend among its members or from which members derive financial profit; but such student organizations or enterprises may use facilities under the same conditions as nonstudent groups.</li> <li>It is recognized that from time to time ad hoc groups or students may wish to use University facilities for purposes of meetings for social events. Such groups may do so only by written permission of the Chancellor.</li> </ol> </li> <li><strong>Use by Non-Student Individuals and Groups </strong><br> <ol class="numeric"> <li>In addition to the general rules and procedures specified above, the following rules apply to use of University facilities by non-student individuals and non-student groups; but this section of the regulations does not apply to official University public functions.</li> <li>Persons who are not students or employees of the University, while on University property, are required to abide by University policies and regulations.</li> <li>Persons who are not current students or employees of the University and who are on University property without specific permission or authorization or without an appropriate purpose may be deemed guilty of trespass. A person shall be deemed to be on University property "without specific permission or authorization" from and after such time as they are requested to leave the property. A person shall be deemed to be on University property "without an appropriate purpose" whenever their presence is not reasonably related to the University's educational function, or an approved University related extracurricular activity.</li> <li>Use of available University facilities may be granted to nonstudent groups for meetings, programs and activities:<br> <ol class="loweralpha"> <li>When the meeting, program and activity is sponsored by or the group is invited by an instructional or administrative division or department as a part of its educational program with the approval of the dean or the appropriate administrative officer of that division or department.</li> <li>When sponsored by a learned, educational, professional, or scientific society for organizational or educational purposes when recommended by a dean or other appropriate administrative officer.</li> <li>Other nonaffiliated and nonsponsored groups may make use of the facilities of the University upon written approval of the Chancellor.</li> </ol> </li> <li>Affiliated groups, as specified above in Section 110.010 E.4.a and E.4.b may be charged an approved fee.</li> <li>Nonaffiliated, nonsponsored groups, as specified above in Section 110.010 E.4.c will be charged a fee approved by the Chancellor.</li> <li>The Chancellor is authorized to establish specific procedures for scheduling and use of University facilities for all meetings of non-student groups to implement these regulations.</li> </ol> </li> <li><strong>Noncommercial Expressive Activity</strong><br> <ol class="numeric"> <li>&nbsp;The Chancellor (or designee) may maintain and enforce reasonable time, place, and manner restrictions for noncommercial expressive activities on outdoor areas of any campus of the University, provided that such restrictions shall:<br> <ol class="loweralpha"> <li>Be in service of significant institutional interests;</li> <li>Employ clear, published, content- and viewpoint-neutral criteria; and</li> <li>Provide for alternative means of expression.</li> </ol> </li> <li>Subject to such reasonable time, place, and manner restrictions, noncommercial expressive activity shall be permitted on outdoor areas of any campus of the University as long as such activity is not unlawful and does not materially and substantially disrupt the functioning of the institution.</li> </ol> </li> <li><strong>Sales, Solicitation, Collections and Advertising in University Buildings or on University Grounds</strong><br> <ol class="numeric"> <li>The sale of anything, the soliciting of subscriptions or the collection of dues is prohibited in the University buildings and upon University grounds without prior authorization of the Chancellor.</li> <li>Recognized student organizations may not solicit subscriptions or collect dues from prospective students or guests of the University when such guests are in University buildings or on University grounds.</li> </ol> </li> <li><strong>Cleaning and Decorations </strong><br> <ol class="numeric"> <li><strong>Cleaning</strong> -- All debris must be removed from buildings and premises immediately following an event by the organization concerned. In case extraordinary cleaning is necessary by the University, the cost of such work shall be paid by the organization creating such a necessity. Staff members and students may be issued keys to University buildings upon the recommendation of the department chairman or administrative head and approval of the official in charge of the building, or his designee, in accordance with established procedures.<br> <ol class="numeric"> <li>Keys are issued for entry to University buildings for the purpose of conducting official business only.</li> <li>An authorized individual entering or leaving a locked building shall not permit any individual to enter who would not normally be permitted to enter the building during the hours it is locked. Min. 9-5-70, p. 35,150.</p> <ol class="upperalpha"> <li><strong>Sound Amplification Devices</strong> -- As used in this regulation, "sound amplification devices" means any electrically operated or assisted device for the amplification of sound including but not limited to public address systems, bullhorns, music or voice amplifiers, megaphones, or any combination thereof.<br> &nbsp;&nbsp;&nbsp; The indiscriminate and non-regulated use of sound amplification devices in the buildings and on the campuses and grounds of the University of èapp is detrimental to and seriously disrupts and impedes the University in accomplishing and carrying out its functions, missions and obligations as an educational institution.</li> <li><strong>Permits Issued by Chancellor</strong> -- The use of sound amplification devices in buildings, on the campus or any site of the University, whether owned by the University or under its control, except as provided below in Section 110.040 B.1, is hereby prohibited unless a permit for the use of the same is first obtained from the Chancellor of the campus on which the use is proposed, or his designated representative.<br> <ol class="numeric"> <li>This regulation shall not be deemed to limit the use of sound amplification devices as a part of and in furtherance of University sponsored and scheduled activities or by University officials, faculty and employees in performance of their duties.</li> <li>Permits issued pursuant to this regulation shall specifically specify the time, duration, location and manner for which the proposed use of a sound amplification device is authorized. The item shall also be listed on a running inventory sheet which shall set forth the item number, the date received and a brief description of the property.</li> <li>A person desiring to reclaim his or her property shall give satisfactory evidence of ownership of the particular item to the personal property reclamation office. If the description of the property and the evidence of ownership is satisfactory, the property is to be returned to the owner. The person reclaiming his or her property shall execute a signed receipt for the property. The item will then be stricken from the inventory list.</li> <li>Disposition of unreclaimed property: After an item has been held for a period of six (6) months and is unreclaimed, the University may sell the property at public auction or may turn the property over to a recognized organization of the University designated by the Chancellor who shall proceed to sell the same at public auction. The proceeds of said sale shall be used by the University or designated organization for some worthy cause or purpose associated with the aims and endeavors of the University as approved by the Chancellor. Notice of said public auction shall be published in the newspaper in the county in which the campus is located at least ten (10) days before said auction. The purpose of this rule is to set forth guidelines for the criteria used and the approvals needed in the naming, establishment, and changes for such exterior areas, landmarks and interior spaces in honor of individuals and organizations.</li> <li><strong>Definitions</strong> – For purposes of this rule, the following definitions shall apply:<br> <ol class="numeric"> <li>“Exterior Areas” shall mean University owned or leased buildings, locations, including open air spaces, and major facilities, such as arenas and stadiums, where the name is displayed on the outside of a structure or is easily viewable by the general public.</li> <li>“University Landmarks” shall mean statues and other landmarks on or in University owned or leased property.</li> <li>“Interior Spaces” shall mean auditoriums, laboratories, class rooms, conference rooms and other significant interior spaces in University owned or leased buildings where the name is displayed inside the building and viewable by those inside the building.</li> <li>“Organizations” shall mean foundations, trusts, not-for-profit entities, corporations or other legal entities.</li> </ol> </li> <li><strong>Approvals</strong> – The following approvals are required to name an Exterior Area, University Landmark or Interior Space:<br> <ol class="numeric"> <li>Exterior Areas – The naming of Exterior Areas requires the approval of the Board of Curators.</li> <li>University Landmarks – The placement, establishment or designation of University Landmarks, as well as the naming thereof, requires approval of the Board of Curators.</li> <li>Interior Spaces – The naming of Interior Spaces requires the approval of the President of the University.</li> </ol> </li> <li><strong>Guidelines</strong> – Names for Exterior Areas, University Landmarks and Interior Spaces should enhance the public reputation of the institution. The following guidelines are suggested in proposing and approving such names:<br> <ol class="numeric"> <li>Faculty, staff members or Organizations who have rendered distinctive service to the University.</li> <li>Graduates, former students, individuals such as Curators, etc., or Organizations who have rendered distinctive service to the University.</li> <li>Persons or Organizations dedicated to the purpose, nature and mission of the University, who have achieved outstanding distinction through civic, intellectual or artistic contributions to the development of the area, state, and nation or to èapp history.</li> <li>Persons or Organizations who make or have made a substantial financial contribution toward the cost of the construction or renovation of the Exterior Area or Interior Space or persons or Organizations who have had a substantial contribution toward the cost of the construction or renovation of the Exterior Area or Interior Space made in their behalf. If named for a donor or a donor's designee, the name should be based on the eminence of the donor or designee and the donor or designee's relationship to the institution as well as the significance of the gift.</li> </ol> </li> <li><strong>Limitations</strong> – Generally, the University shall name no more than one Exterior Area or University Landmark to honor an individual or Organization. The naming of more than one Exterior Area or University Landmark to honor the same person or Organization shall require an express determination and vote by the Board finding that it is in the University’s best interest to permit such an additional naming.</li> <li><strong>Reservations</strong> – The Board reserves the right to change or remove the name of an Exterior Area or Interior Space, or the name, placement, establishment or designation of a University Landmark,&nbsp;if it determines that the name is detrimental to the best interests of the University.
