HR-410 Legal Proceedings

Summary

Employees involved in legal proceedings may be eligible for paid or unpaid time off to attend legal proceedings depending on the nature of employee involvement.

If any part of this policy does not reflect the Collected Rules and Regulations (CRR), the provisions of the CRR will govern.


Policy

CRR 340.120: Leave for Legal Proceedings, including:

  • Serving as a witness under subpoena
  • Serving as an expert witness
  • Jury service
  • Other legal proceedings

Further HR Policy Provisions

Additional HR-410 policy provisions below in accordance with CRR 340.120:

  1. Any employee who is a party in a legal proceeding without a subpoena, and is required to be absent from duty, is permitted time off.
    1. Administrative, service and support employees and certain non-regular academic employees as approved by the chancellor and president must use all available accrued paid time off.
    2. Any full-time or part-time academic employee will be permitted time off without loss of pay.
    3. Any other employee will be permitted time off without compensation.
  2. Any employee who is required to be absent from duty in order to attend their own Worker's Compensation conference or hearing is permitted time off without loss of University compensation or accumulated paid time off days.
  3. Employees should work out arrangements with their immediate supervisor to ensure that all responsibilities are met during absences due to legal proceedings.
  4. Legal proceeding absences must be recorded in the university’s central payroll system as part of the regular payroll processing cycle, using the appropriate time reporting code.
